Every workplace in India with 10+ employees must constitute an Internal Complaints Committee (ICC). Any aggrieved woman may file a written complaint within 3 months of the incident (extendable by another 3 months for sufficient cause). 1. Pick the nature of conduct (§2(n) PoSH Act)

Section 2(n) defines sexual harassment broadly. Pick whichever applies — you may describe multiple categories of behaviour in the facts section below.

What happens after you file

The ICC must follow a strict statutory timeline. You have the right to interim relief, confidentiality, and a fair inquiry.

Day 0-7 Receipt + response

ICC sends 1 copy to respondent within 7 working days. Respondent files reply within 10 working days. Conciliation may be offered (§10) only at your request.

Day 0-90 Inquiry

§11 inquiry must complete in 90 days. Both sides examined. Interim relief under §12 (transfer, leave up to 3 months on full pay, no-contact direction) available throughout.

Day 90-150 Report + action

ICC submits report to employer within 10 days of finishing inquiry (§13). Employer acts within 60 days. Right to appeal under §18 within 90 days of recommendation.

Your rights during the inquiry

Confidentiality (§16)

  • Identity of complainant, respondent, witnesses + contents of complaint cannot be made public
  • Breach of confidentiality is itself a punishable contravention (§17)
  • You may write under a pseudonym in any external communication while inquiry is on

Interim relief (§12)

  • Transfer of yourself or respondent to a different workplace
  • Leave up to 3 months on full pay (over and above your regular leave)
  • Direction to respondent not to report on your work / appraisal
  • Any other relief the ICC considers fit
