How to file on Samadhan portal
- Visit samadhan.labour.gov.in — official Government of India Labour Ministry grievance portal.
- Register / Login with your mobile number (OTP based). Worker registration is free.
- Select "Submit Grievance" and choose the appropriate authority: CLC(C) for inter-state, Regional Labour Commissioner, or State Labour Department.
- Paste your generated draft into the description box and attach evidence (offer letter, payslips, WhatsApp screenshots, email threads).
- Note your grievance ID — track status online. Authority typically responds within 30 days; conciliation conducted within 60 days.
- Escalation routes: If conciliation fails — file before Labour Court (Industrial Disputes Act §10), Wage Authority (Payment of Wages Act §15), or PF Tribunal.
Key points
- Limitation: Payment of Wages Act — 12 months from date of deduction. Industrial Disputes Act — 3 years from termination. PF — no limit if employer is registered.
- If you faced sexual harassment, use our POSH ICC wizard instead — that has different legal mechanism.
- Preserve evidence: offer letter, payslips, appointment letter, WhatsApp/email threads, attendance records. Take screenshots BEFORE complaining.
- For salary > ₹24,000/month or managerial roles — Industrial Disputes Act may not apply; civil suit or specific contract law route.
