On July 1, 2024, India replaced its three colonial-era criminal laws — some over 160 years old — with three new statutes. This is the most significant overhaul of Indian criminal law since independence.
The Three Replacements
Key Changes That Affect You
1. Zero FIR — File Anywhere
Under the new BNSS, you can file a Zero FIR at any police station, regardless of where the crime occurred. The police must register it and transfer it to the appropriate jurisdiction.
2. Mandatory Investigation Timelines
Police now have strict deadlines: 90 days for serious offences, 60 days for less serious ones. If the charge sheet isn't filed in time, you're entitled to default bail.
3. Community Service as Punishment
BNS introduces community service as a punishment for petty offences. This is a first for Indian criminal law and aims to reduce prison overcrowding.
4. Electronic/Digital Evidence
The new BSA explicitly recognizes electronic records, emails, social media posts, and digital signatures as admissible evidence.
5. Victim-Centric Provisions
New provisions ensure victims are kept informed about investigation progress. BNSS mandates victims receive updates at each stage, and FIR status can be tracked online.
